Nesshgo Vehicle Rental Privacy Policy

By renting a vehicle from Nesshgo, you, the Renter, confirm that you have read, understood, and agreed to adhere to the following terms and conditions during the rental period or any extended period.

1. Vehicle Usage

Personal Use Only: The vehicle is provided by Nesshgo for personal use only. It is prohibited to use the vehicle for any commercial purposes or unlawful activities.
Driving License: The Renter must possess a valid and current driver’s license throughout the rental period. The vehicle must only be driven by the Renter or any authorized individual with a valid driving license.
Vehicle Modifications: The Renter must not modify, alter, or repair the vehicle or its accessories in any way. Any unauthorized changes will result in additional charges and liability for the Renter.
Usage Restrictions: The Renter must use the vehicle within the Permitted Territory (India only) and must not drive the vehicle beyond this area without prior written approval from Nesshgo.
Permissible Capacity: The Renter must not allow the vehicle to carry more passengers than the specified seating capacity.
Towing: The vehicle must not be used for towing any other vehicle or trailer.
Speeding and Impairment: The vehicle must not be driven beyond the legal speed limits, and it must not be operated under the influence of alcohol, drugs, or any condition that impairs driving ability.

2. Traffic Violations

The Renter is fully responsible for any traffic violations incurred during the rental period, including fines for illegal parking, speeding, or toll violations. The Renter must report any traffic violations to Nesshgo promptly, within the prescribed time frame.

3. Accident and Theft of Vehicle

Accidents: In case of an accident, the Renter is solely responsible for any damage caused to the vehicle, any third-party injuries, or property damage. The Renter must immediately report the incident to Nesshgo and cooperate fully with law enforcement if necessary.
Theft: In case of theft, the Renter must notify Nesshgo immediately and file a police report. The Renter is responsible for the difference between the book value of the vehicle and the insurance settlement in case of theft.

4. Vehicle Condition and Fuel

Fuel Level: The vehicle is handed over to the Renter with a specific fuel level. The Renter is responsible for returning the vehicle with the same amount of fuel. Failure to do so will result in additional refueling charges.
Vehicle Condition: The Renter must return the vehicle in the same condition as it was received, except for normal wear and tear. The Renter will be liable for any damage to the vehicle caused during the rental period.

5. Security Deposit

A Security Deposit is required at the time of booking. This deposit will be used to cover any damages, fines, or unpaid charges during the rental period. The deposit will be refunded at the end of the rental period, after deducting any applicable charges.

6. Rental Charges

Additional Charges: The Renter agrees to pay all rental charges, including any additional charges for excess mileage, late returns, or damages to the vehicle.
Toll and Road Charges: The Renter is responsible for any tolls, parking fees, and other road-related charges incurred during the rental period.

7. Vehicle Delivery and Collection

Delivery: The vehicle will be delivered to the Renter at the agreed-upon location. The Renter must be present to accept delivery and provide identification documents as required.
Return: The vehicle must be returned to Nesshgo at the specified location, on the date and time agreed upon. If the vehicle is returned late, additional charges will apply.

8. Insurance

Third-Party Insurance: The vehicle is covered by basic third-party insurance. However, the Renter will be responsible for any damage caused to the vehicle or third-party property beyond the coverage provided by the insurance policy.
Exclusions: Insurance does not cover damages resulting from the Renter‘s negligence, misuse of the vehicle, or illegal activities.

9. Prohibited Uses

The Renter must not use the vehicle:

For commercial purposes (e.g., ride-hailing, goods transportation).
To participate in racing, rallies, or other motorsport events.
For illegal activities or to transport hazardous materials.
For any purpose not in line with the vehicle manufacturer’s guidelines.

10. Breakdown and Roadside Assistance

In the event of a breakdown, the Renter must contact Nesshgo immediately for roadside assistance. The Renter must not leave the vehicle abandoned and is responsible for any associated costs incurred due to improper handling of the situation.

11. Compliance with Laws

The Renter must comply with all applicable laws, including traffic laws, and adhere to safety regulations, such as seat belt use. Nesshgo will not be responsible for any violations or legal actions resulting from the Renter‘s failure to comply.

12. Modification or Termination of Rental

Cancellation: The Renter may cancel the booking as per Nesshgo’s cancellation policy. If the Renter cancels after a certain period, cancellation charges may apply.
Termination by Nesshgo: Nesshgo reserves the right to terminate the rental agreement immediately if the Renter violates any of the terms outlined herein or engages in prohibited activities.

13. Limitation of Liability

Nesshgo shall not be liable for any indirect, incidental, or consequential damages arising from the use of the vehicle. The Renter is responsible for any loss or damage caused during the rental period.

14. Governing Law

This Agreement is governed by the laws of India. Any disputes arising from this Agreement will be resolved in the courts of the jurisdiction in which Nesshgo operates.
