Effective Date: The terms and conditions set forth in this agreement become effective once a booking is confirmed through the Nesshgo platform, whether accessed via the website or mobile app.
Lessor: The owner of the vehicle listed on the Nesshgo platform.
Lessee: The person booking the vehicle for rent via the Nesshgo platform.
This Vehicle Lease Agreement (the “Agreement”) is made between the Lessor and the Lessee upon the Lessee’s booking of a vehicle from the Nesshgo platform. By agreeing to the booking, both parties agree to the terms outlined in this Agreement.
In this Agreement:
“Applicable Laws” refers to all Indian laws and regulations relevant to vehicle leasing and the use of vehicles.
“Vehicle” refers to the car being leased, including all accessories and components.
“Platform” refers to the website and mobile application operated by Nesshgo for facilitating vehicle leases.
“Permitted Territory” refers to the geographical area within India where the vehicle can be used, excluding regions like Ladakh and international travel.
The Lessor agrees to lease the vehicle to the Lessee under the conditions outlined in this Agreement. Ownership of the vehicle remains with the Lessor at all times, and this Agreement does not transfer any ownership rights to the Lessee.
The vehicle is to be used solely for personal, non-commercial purposes within the Permitted Territory. Prohibited uses include:
Commercial use or transporting passengers or goods for hire.
Participation in races or competitive events.
Any illegal activities or misuse.
The lease term will begin from the Delivery Date and end on the date specified in the booking. The lease may be extended upon mutual agreement.
The vehicle will be delivered to the Lessee at the agreed location, along with all necessary documentation. The Lessee must be present to receive the vehicle, verify its condition, and sign delivery receipts.
The Lessee agrees to pay the Lease Rental in advance as specified at the time of booking. This rental includes the cost of the vehicle usage, maintenance, insurance, and delivery fees (if applicable).
The Lessee is fully responsible for the vehicle’s safety and must notify Nesshgo in case of theft, damage, or accidents. Any financial liabilities for accidents or theft, not covered by insurance, will be borne by the Lessee.
The Lessee is responsible for any traffic violations, fines, or fees during the lease term. If the vehicle is confiscated or impounded, the Lessee will be liable for all related costs and cooperate with authorities to secure the vehicle’s release.
The vehicle will be insured by Nesshgo for third-party liability. However, the Lessee will be responsible for any damages not covered under the policy. The Lessee should immediately report any damages or accidents to Nesshgo.
The Lessee must ensure that the vehicle is maintained in good condition. In the event of any necessary repairs or maintenance, the Lessee must contact Nesshgo or its authorized service provider for approval before proceeding.
During the lease term, the Lessee must:
Maintain the vehicle’s cleanliness and condition.
Use the vehicle only as permitted and avoid prohibited use.
Keep the vehicle secure when not in use.
Ensure compliance with all traffic laws and regulations.
Nesshgo may terminate the lease agreement if the Lessee violates any of the terms. In such cases, the Lessee will be liable for any unpaid rental fees or additional charges.
Upon the end of the lease term or early termination, the Lessee must return the vehicle to the designated location. The vehicle must be in good condition, except for normal wear and tear.
Both parties agree to protect any confidential information exchanged during the course of this Agreement and will not disclose such information to any third parties without consent, except as required by law.
The Lessee agrees to indemnify Nesshgo against any costs or damages resulting from the Lessee’s breach of this Agreement, including misuse of the vehicle or failure to comply with applicable laws.
This Agreement is governed by the laws of India, and any disputes will be resolved in the courts of the jurisdiction where Nesshgo operates. All amendments to this Agreement must be made in writing and signed by both parties.
